FIXATION OF PAY IN RESPECT OF TEACHERS IN UPGRADED PAY SCALES-REG.

As Order dated 23/12/2014 published on the Website of the AIKVTA, KVS withdraw the Fixation of pay in r/o teachers in the upgraded pay scales issued by KVS on dated 14/11/2014. The text matter of the said order is as follow :

Sub : Fixation of pay in respect of teachers in the upgraded Pay scales recommended by 6th CPC - Exercise of fresh option to Switch over to CCS (RP) Rules, 2008 reg:-

Sir/Madam,

            I am directed to invite a reference to this office letter of even number dated 14/11/2014 vide which a clarification regarding exercise of fresh option to switch over to CCS(RP Rules, 2008 and consequent fixation of pay in respect of teachers was issued to your office for further circulation to Vidyalayas under your jurisdiction.

           In this connection it is stated that the matter regarding the implementation has been reviewed with reference to the judgement dated 25/02/2014 passed by Hon'ble CAT, Principal Bench, New Delhi in OA No. 1108/2011 filed by Govt. school Teachers Association & others, New Delhi vs UOI & others. The operative part of the judgement states as under :

          "We feel that there is clear distiction between the TGT/PGT cadre and the Assistant/Steno Cadre, While merging the Scales of Rs. 5000-8000, Rs. 5500-9000 and Rs. 6500 to 10500/- and giving the higher scale of Rs. 7450/--11500/- from 1.1.2006 to the TGT and Assistants/Personal Assistants, they were not sustantive scale/posts created and merged wheras i the case of Assistant/Personal Assistant, substantive revised scale of Rs. 6500-10500//- was given to the Assistant/Personal Assistant unlike to the other cadres such TGT. Therefore, while senior scale of TGT got replaced in the same pay scale on promotion to PGT i.e. Rs. 6500-10500, the Assistant, on the other hand were already in the substantive scale of Rs. 6500-10500/ as result of substantive pay revision when the 6th CPC had not given his recommendation. Therefore, the two are clearly on separate footing and the question of addtion of one increment in the case of TGT will not apply. Moreover, the two cadres are completely different as regard job responsibilities and nature of work and hence, cross-cadre comparisons erroneous. We therefore come to the conclusiton that there is no infirmity in the oreders/clarification dated 10.12.2009, issued by the respondents in respect of Assistant/Personal Assistants cadre and this will not automatically apply on TGT/PGT cadre. "

In the light of the above, it has now been decided by the Competent Authority to withdraw the clarification letter issued by this office lewtter of even number dated 14th November, 2014 with immediate effect.
